WHEN DOES A MARIJUANA/HASH FINE GET TIME-BARRED?

On this post, here you have all the necessary information to know when a marijuana/hash-possession fine gets time-barred.

First of all, article 36, paragraph 16, of Organic Law of Protection of Citizens’ Security, considers drug consumption or illegal drug possession as a serious infringement – with no drug-trafficking evidence and no aggravating circumstances (article 33.2), the penalty imposed will be applied to a minimum extent.

Amount

As a serious infringement, consumption/possession fines cost 601-10,400 within the minimum range, €10,401-20,200 within a medium range, and over €30,000 within a maximum range.

However, if fined within two years, minimum infringements could get medium – up to €20,200 if the worst comes to the worst.

Usually, fines are applied within a minimum extent – 50% cash discount, i.e., usual €300 fines within rapid payment (exaggerated amount in a country with an average salary of €1,000/month).

Time-barring

It cannot be precisely specified how long the fine takes to go home – two years at the latest: after two years, the fine will get time-barred – no obligation to settle the stipulated amount.

If cought again, delivery speed restarts from the last fine.

Removing lies

Many consumers think that, if the fine doesn’t go home due to wrong address, or they don’t collect it, they have no obligation to pay it, but nothing could be more untrue – if it doesn’t go home due to wrong address or non-collection, it’ll be published on the Official Bulletin (fined anyway).

Ignored notices, or wrong address, avoid your right to appeal, but you’ll have to pay for the amount anyway; we hope these lines have been helpful.
